§ 34-59. Permit issuance.
(a)
Presence of potential pollution sources. The city shall not issue any permit for the construction and/or development of any well or spring, nor shall any supplier from a publicly owned or operated system construct or operate any well or spring, where the following potential pollution sources are known to be present within the inner management zone:
(1)
Underground storage tanks;
(2)
Nondomestic septic tanks with drain fills;
(3)
Animal feedlots;
(4)
Poultry enclosures; or
(5)
Animal enclosures.
(b)
Application to family pets. This rule shall not be construed to apply to family pets or environmental facilities permitted by the division or other potential pollution sources identified in the inventory if the city engineer has determined that there will be no releases to the ground or that all releases will be to a sanitary sewer or that such releases, if they occur, will not be a threat to public health and safety. This rule shall apply to domestic septic tanks with drain fills should it be determined that releases from the domestic septic tank would be a threat to public health and safety; provided, however, the city engineer may issue a permit following modifications of the well design, including the depth of the well that would protect the public health and safety.
